Subject: 10124/1994-195 Walker, Don Date: Mon, 27 Feb 1989 12:20:00 -0500 1994-195 Don Walker ORDINANCE NO. 10124 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO AMEND CONDITIONS IN ORDINANCE NO. 9259 ON A TRACT OF LAND LOCATED AT 4414 AND 4416 BRAINERD ROAD, BEING ON THE SOUTHWEST LINE OF BRAINERD ROAD AT LONSDALE DRIVE. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to remove conditions from Ordinance No. 9259 on: A tract of land located at 4414 and 4416 Brainerd Road, being on the southwest line of Brainerd Road at Lonsdale Drive. Part of lot 7, block E, Re-amended Plat of Belvoir Place, as shown by plat of record in plat book 11, page 8, ROHC. Said part of lot begins at the intersection of the southwest line of Brainerd Road with the southwest line of Lonsdale Drive, thence on a curve southeast and southwest some 90 feet with Lonsdale Drive to the northwest line thereof, thence southwest some 92 feet with Lonsdale Drive, thence northwest some 78 feet to a point 80 feet southwest of the southwest line of Brainerd Road (if measured at a right angle), thence northwest some 56 feet parallel to, and at all points 80 feet southwest of, the southwest line of Brainerd Road to the northwest line of said lot 7, thence northeast 80 feet with said lot line to the southwest line of Brainerd Road, thence southeast 146.3 feet with Brainerd Road to the southwest line of Lonsdale Drive, the point of beginning. Tax Map No. 157J-J-14. and substitute in lieu thereof the following new conditions: 1. Approval of access by City Traffic Engineer, provided that no curb cut, entrance or exit shall be allowed on Lonsdale Avenue. 2. The area between the curbing and Lonsdale Avenue and also the area along the south property lines of Lot A and B will be attractively landscaped and kept maintained. Access from both Lot A and Lot B onto Lot C will be prevented by the use of landscaping or curbing or a combination of the two. 3. No building may be erected on said tract in excess of one story. 4. Applicant will rebuild the subdivision monument at the corner of Brainerd Road and Lonsdale Avenue and will landscape the area around it along with the traffic triangle at said intersection. SECTION 2.
